These Terms of Use govern your conduct associated with the customer ratings and review service offered by DribbleUp, Inc. through its website and App (the "CRR Service"). To the extent of any conflict between DribbleUp, Inc.'s Privacy Policy and these Terms of Use, these Terms of Use shall control with respect to the CRR Service.
By submitting any content to DribbleUp, Inc., you represent and warrant that:
you are the sole author and owner of the intellectual property rights thereto;
all content that you post is accurate;
use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity;
you are at least 18 years of age if submitting content through our website;
you are a bona fide DribbleUp, Inc. user and/or customer.
You further agree and warrant that you shall not submit any content:
that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
that is, or may reasonably be considered to be, profane, obscene, vulgar, or sexually explicit, or that is inappropriate with respect to race, gender, sexuality, or ethnicity;
that includes any personal information or information that references other URLs, addresses, email addresses, contact information or phone numbers;
that is unrelated to our products or services;
that contains any computer viruses, worms or other potentially damaging computer programs or files.
You shall comply with the Federal Trade Commission’s Guides on the Use of Endorsements and Testimonials in Advertising. Without limiting the generality of the foregoing, this means that if you received compensation in any form (including free product) or any other incentive (such as a free App avatar) in exchange for providing content for posting content on DribbleUp, Inc.'s sites or channels, then this must be disclosed in such post. All disclosures must be made clearly and conspicuously. DribbleUp, Inc. will separately employ reasonable measures to clearly and conspicuously disclose any compensation, free product or incentive received in exchange for submitting a rating or review.
You agree to indemnify and hold DribbleUp, Inc. (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.
For any content that you submit, you hereby grant DribbleUp, Inc. an unrestricted, assignable, sublicensable, perpetual, royalty-free, fully paid-up license throughout the world to reproduce, distribute, publicly display, transmit, communicate to the public, publicly perform on a through-to-the-audience basis, create derivative works from, and otherwise use and exploit (collectively, “Use”) all content that you submit, for any purpose, including promoting and marketing DribbleUp, Inc. and its products. You further grant DribbleUp, Inc. a royalty-free license to Use the name, image, and likeness of any person identifiable in any content you submit. By submitting content, you waive any and all rights of publicity, privacy or any other rights of a similar nature, in addition to any moral rights you may have in your content.
All submitted reviews are read by our moderators and are subject to the terms set forth in our Terms of Use and content guidelines. DribbleUp, Inc. reserves the right to delete or not post any content on DribbleUp, Inc.’s website that it deems, in its sole discretion, to violate the content guidelines, any other provision of these Terms of Use, including but not limited to, deleting personal information contained within your content. Some reviews may get flagged, reviewed, and then later removed by our moderation team after previously appearing on our website. DribbleUp, Inc. does not guarantee that you will have any recourse through DribbleUp, Inc. to edit or delete any content you have submitted.
DribbleUp, Inc. may require you to provide certain information or data in order to submit a review, such as, but not limited to, your email address to verify that you are a DribbleUp, Inc. customer. By submitting a review, you agree and consent to DribbleUp, Inc.’s promotional use and display (whether online or offline) of all such information or data you provide with, or as part of, your review.
